The complexity of modern government means that much governing is done not by the traditional three branches but by administrative agencies with quasi-legislative and quasi-judicial, as well as executive, functions. This course explores administrative process and procedure: how, in the federal government, the Constitution, Congress (through organic statutes and the Administrative Procedure Act), the courts, and the agencies themselves help define the powers and responsibilities of the independent and executive agencies. The course examines specific agencies as bureaucratic institutions, considers approaches to regulatory reform, and specially emphasizes the courts.

This course will cover the basic procedural and substantive issues involved in the filing, preparation, and arguing of an appeal, including the requirement of preservation and the applicable standard of review.

Working with a case file, students will have the opportunity to prepare an appellate brief and engage in oral arguments, thereby developing advanced skills in both written and oral advocacy. Students will have opportunities to become involved in actual appeals by observing practicing appellate arguments and participating in moots to help prepare appellate attorneys for oral arguments.

Approved for the Experiential Learning Requirement. Satisfies either the Experiential Learning Requirement or the Writing Requirement.

Advanced Business Immigration and the Global Employee

This course examines the complex legal and strategic issues that arise when businesses employ talent across borders. Using real-world-inspired hypotheticals, students explore the substantive and procedural dimensions of business immigration law and its intersection with other areas such as criminal law, family law, and corporate law.

The course is structured as a collaborative, practice-oriented simulation. Students are organized into 鈥渓aw firms,鈥 while alumni practitioners serve as 鈥渟enior counsel.鈥 Prior to each class, students complete the assigned readings and analyze hypothetical client scenarios drawn from real-world immigration matters. Working in their firms, students develop case strategies as 鈥渁ssociates,鈥 present their analyses to their peers and senior counsel, and refine their approach through discussion and feedback. Once each firm reaches a cohesive strategy, the groups present their recommendations to the class for broader discussion.

For each class session, students prepare a written analysis of one assigned hypothetical for submission while participating in group discussions for all scenarios. These written submissions, together with in-class strategy presentations, form a significant component of the course grade. Students are also evaluated on the presentation of a research topic and a short final paper, with the option to complete a longer paper to satisfy the Law School鈥檚 writing requirement.

By working closely with alumni practitioners throughout the semester, students gain insight into the practical challenges of advising global employers and foreign national employees. The course鈥檚 interactive format not only deepens students鈥 understanding of business immigration practice but also fosters mentorship and networking opportunities with practicing attorneys in the field.

Advanced Topics in Dispute Resolution

This seminar course offers the opportunity for intense and robust investigation of discrete issues arising in the course of resolving disputes by means other than the courts. Students will prepare and discuss issues of public policy, practice, and theory, and they will be responsible for original scholarship on a topic of their choosing. Issues may include cross-cultural negotiation, investor-state conciliation, public policy of mediation confidentiality, consequences of diversity in arbitration, mediation practices outside the United States, and conflict resolution in religious communities.

The course is the post-introductory offering in Alternative Dispute Resolution (ADR). It will require students to become conversant with current issues of policy regarding court-annexed and independent dispute resolution processes with an emphasis on such topics as implicit bias in 鈥渘eutral鈥 arbitrators and mediators; the increasing concern of lack of diversity among ADR practitioners; the impact of globalization on traditionally culturally homogeneous approaches to ADR; and broad public policy questions such as class action waiver and confidentiality of mediation communications.

Advocacy of Criminal Cases

Advocacy of Criminal Cases (ACC) introduces students to the law and skills involved in criminal practice. The topics covered include charging, arrest and pre-trial release, discovery, suppression and exclusion of evidence, and trial. The skills developed include information acquisition (interviewing, direct and cross examination, and drafting discovery requests), development of a case theory, case planning, and persuasion (memoranda of law, oral argument and summation). The course follows New York鈥檚 penal and criminal procedure laws and rules of evidence. The twice weekly seminars alternate between skills exercises, discussion of criminal law, procedure and ethics, and simulations of the major stages of a criminal case from post-arrest through jury trial. Throughout the semester, student litigation teams consisting of two prosecutors and two defense attorneys, each supervised by faculty, litigate a single criminal case.

The semester-long case simulation includes interviews (police, client and witness), arraignments (local criminal and superior courts), a probable cause hearing, scheduling conferences, plea negotiations, a suppression hearing and argument, and a full-day jury trial. In addition, students draft accusatory instruments, discovery and suppression motions, memoranda of law, and requests to charge. Approximately half of the seminar sessions are devoted to focused skill exercises and drills as well as discussion designed to prepare the students for their roles in the semester-long case simulation.

Approved for the Experiential Learning Requirement. Trial Advocacy may not be taken in the same semester as ACC. Enrollment is limited. Registration is binding. Application and Mandatory Information Session are required, and the application can be found in Student Resources on the .

Asylum Clinic

Students in this course are trained to represent immigrant clients under faculty supervision and argue cases in the Immigration Court and before the Newark and New York Asylum Offices on behalf of refugees fleeing persecution in their home countries and seeking safety in the United States. The seminar portion of the course will use simulations to enhance interviewing, counseling, and litigation skills. Students will build skills such as interviewing, researching and writing declarations and briefs, fact development, some trial advocacy, as well as working with survivors of torture and trauma, cultural awareness, and engaging with interpreters. Students will learn about the substantive law and procedure of immigration, refugee, and asylum law and will receive instruction on immigrant access to public benefits. Guest speakers and visits to Immigration Court to and detention centers to observe proceedings will further strengthen students鈥 knowledge.

Under faculty supervision, students will interview and counsel clients; conduct fact investigation and discovery; draft pleadings, correspondence, and motions; perform legal research and analysis; collaborate with social work professionals and country conditions experts; engage with interpreters; and appear with clients before the Immigration Courts and at the Asylum Offices. Students will also engage in community outreach through Know-Your-Rights presentations and systemic advocacy. Students may also work to develop resources for courts, attorneys, and clients related to immigration law or collateral immigration consequences in other areas. The precise work conducted during the semester will depend on clients who need representation and the posture of these cases.

In this upper-level clinic, students will be trained to represent immigrant clients under faculty supervision and argue cases in the Immigration Court and before the Newark and New York Asylum Offices on behalf of refugees fleeing persecution in their home countries and seeking safety in the United States. In addition to the fieldwork, students will attend a weekly seminar. Students are expected to regularly devote a minimum of 16 hours per week to the course.

Approved for the Experiential Learning Requirement. Enrollment is limited. Registration is binding. Application and interview are required, and the application can be found in Student Resources on the .

This course provides an in-depth analysis of the Bankruptcy Code, including commencement of a case, the automatic stay, exemptions, trustees avoiding powers, distribution, priorities, and discharge. The course covers selected state debtor/creditor law, including pre- and post-judgment remedies, fraudulent conveyances, exemptions, liens, and security interests. Although issues involving corporate debtors are addressed, the course focuses on Chapter 7 (liquidation) and Chapter 13 (individual repayment programs).
