Dispute Resolution Processes

This course addresses the skills involved in domestic commercial dispute identification, management, and resolution using methods other than litigation, and, specifically, negotiation, mediation, and arbitration. The course will also briefly address hybrid dispute resolution processes and conflict anticipation and management through contract drafting, systems design, and other methods. The aim of the course is to enable attorneys to counsel clients on the most effective and appropriate ways to anticipate, manage, and resolve business disputes by means other than litigation.

Students are presented with simulation exercises, along with lectures and classroom discussions of the ADR systems surveyed. The course is graded on the basis of performance on the simulations, writing assignments (including a final paper), and multiple-choice quizzes.
